An 80-year-old grandmother in Michigan who used medical marijuana was put overnight in jail after an officer discovered her with less than an 8th of an ounce of Cannabis and an expired medical marijuana card.

Delores Saltzman and her son say that she uses the medical marijuana to alleviate pain from surgeries and from her arthritis. She lives with arthritis, diverticulitis, muscle and bone aches, but she says cannabis keeps her moving and making art.

According to court records, Deputy Ashley Gruno was trying to find Saltzman’s great granddaughter and return her lost phone and ID when the deputy smelled marijuana from the porch. Gruno asked whose it was, to which Saltzman stated that it was hers.

Court records show the deputy seized several pipes, four joints and one purple jar with an undisclosed amount of cannabis, which Saltzman has said was less than 1/8th of an ounce. She was then transported to jail, where she stayed overnight.
